This Privacy Policy applies to all ConAxis services, including SMS operational messaging.

1. Introduction

ConAxis (“ConAxis,” “we,” “us,” or “our”) is a city-scale dispatch automation engine and contractor coordination network headquartered in San Antonio, Texas. ConAxis connects licensed general contractors with pre-verified subcontractors for emergency and same-day labor coverage. ConAxis does not operate as a staffing agency. Its platform functions as an operational coordination network, using SMS as its primary communication layer for dispatch, availability monitoring, and crew coordination.

ConAxis is committed to protecting the personal and business information of every subcontractor, general contractor, and other individual who participates in the ConAxis network. This Privacy Policy governs how ConAxis collects, uses, stores, shares, and protects information provided by or about users of the ConAxis platform, dispatch system, and SMS coordination network.

This Privacy Policy applies to all persons who interact with ConAxis through the onboarding process, SMS communications, document submission, or any other channel through which ConAxis collects operational or identifying information. Use of the ConAxis service, including participation in the dispatch network or responding to ConAxis SMS communications, constitutes acceptance of this Privacy Policy in full. If you do not agree with this policy, you should not participate in the ConAxis network.

2. Information We Collect

ConAxis collects information through several distinct channels: the initial phone intake process, ongoing SMS communications, document submission, and automated background verification systems. Each channel and the specific categories of information collected are described below.

A. Information Collected by Phone Intake

During the initial onboarding call conducted by a ConAxis operator, the following information is collected directly from the subcontractor or their representative:

  • Business name and company identity
  • Primary and after-hours dispatch phone numbers
  • Trade type and area of specialization
  • Service area and geographic coverage radius
  • Typical crew size and maximum emergency crew capacity
  • Foreman name and direct mobile contact number
  • Insurance agent email address
  • Emergency availability status

This information forms the foundation of a subcontractor’s profile in the ConAxis dispatch network and is used to match the subcontractor with relevant labor coverage opportunities.

B. Information Collected via SMS

ConAxis collects operational data through the SMS interactions that occur as part of routine network activity. This includes, but is not limited to:

  • Availability status updates communicated via keyword responses (e.g., CREW, AVAILABLE, TODAY, ZIP, FOREMAN)
  • Crew size updates
  • ZIP code and service area updates
  • Dispatch acceptance or decline responses
  • Operational status messages and free-text responses

All SMS data received by ConAxis is processed and used to update the subcontractor’s operational profile in real time.

C. Information Collected via Document Upload

ConAxis may collect documents submitted by subcontractors or their representatives for purposes of credential verification and compliance tracking. These documents may include:

  • Certificates of Insurance (COI)
  • Trade licenses and government-issued certifications
  • OSHA and safety certifications
  • Insurance documentation and endorsements

Documents submitted to ConAxis are processed for verification purposes and are retained in accordance with the data retention provisions of this policy.

D. Automated Verification Signals

ConAxis operates background verification processes that automatically collect certain signals from publicly available government and regulatory sources. These processes run continuously or periodically to maintain the accuracy and reliability of the dispatch network. Automatically collected data includes:

  • Entity status records from the applicable Secretary of State database
  • Tax standing records from the applicable State Comptroller database
  • Permit activity data from city and municipal permit portals
  • Insurance expiration data derived from COI document scanning
  • SMS response time and dispatch reliability data generated through platform interactions

These automated signals are used exclusively for internal verification and scoring purposes. They are not shared with external parties.

3. How We Use Your Information

ConAxis uses the information collected through its platform solely for operational purposes directly related to the function of the contractor coordination network. Specifically, ConAxis uses collected information for the following purposes:

  • Matching subcontractors with general contractor labor requests based on trade type, geographic coverage, and crew availability
  • Dispatching emergency and same-day coverage opportunities to qualified, available subcontractors
  • Computing and maintaining live availability scores and dispatch reliability ratings for each subcontractor in the network
  • Sending operational SMS messages, including availability checks, dispatch alerts, job confirmations, and weekly pulse checks
  • Verifying contractor credentials, licensing status, insurance standing, and compliance with applicable requirements
  • Building and maintaining the Live Capacity Matrix and Panic Link tools used by general contractors to identify available labor resources
  • Conducting internal operational analytics and system performance improvement
  • Contacting insurance agents or brokers on file for purposes of Certificate of Insurance coordination and verification

ConAxis does not sell personal information to third parties under any circumstances. ConAxis does not use any personal or business information collected through its platform for marketing, advertising, or promotional purposes unrelated to dispatch operations.

4. SMS Communications and Consent

SMS messaging is the primary operational communication layer of the ConAxis platform. The following subsections govern the types of SMS messages sent by ConAxis, the basis and method of consent, message frequency, applicable charges, opt-out procedures, and support instructions. All subcontractors and contacts in the ConAxis network are subject to the terms of this section.

A. Types of SMS Messages Sent

ConAxis sends the following categories of SMS messages to individuals enrolled in the dispatch network:

  • Emergency Dispatch Alerts: Notifications of available labor coverage opportunities matching the recipient’s trade type and geographic service area. These messages are sent when a matching opportunity arises and require a timely response.
  • Availability Pulse Checks: Periodic requests to confirm current crew availability. Example: “ConAxis check-in: Are you open for additional work next week? Reply 1 = Yes, 2 = Limited, 3 = Booked.”
  • Dispatch Confirmations: Confirmation messages sent when a crew placement is accepted and finalized by both the subcontractor and the requesting general contractor.
  • Operational Update Requests: Messages requesting updates to crew size, service area ZIP code, or foreman contact information when changes in operational status are indicated.
  • Onboarding Confirmation: An initial activation message sent immediately upon completion of the phone intake process confirming enrollment in the ConAxis dispatch network.
  • Speed Test / Reflex Messages: Occasional rapid-response messages used to measure and maintain dispatch readiness within the network. These messages are infrequent and operationally purposeful.

B. SMS Consent — Verbal Consent During Phone Intake

Consent to receive SMS communications from ConAxis is obtained verbally during the initial onboarding phone intake call. Prior to collecting a phone number for dispatch purposes, the ConAxis operator clearly informs the subcontractor or their representative that enrollment in the network includes receipt of operational SMS messages from ConAxis, including dispatch opportunities, availability checks, crew coordination updates, and related operational communications.

By providing a phone number and verbally agreeing to be contacted during the recorded or logged intake call, the subcontractor provides valid consent to receive these messages. No separate written signature is required for this consent to be effective. Verbal consent obtained during the intake call is documented in the ConAxis system and constitutes the basis for all subsequent SMS communications.

Consent granted under this section is specific to operational dispatch communications and does not constitute authorization for unrelated promotional or third-party marketing messages. ConAxis will not transmit promotional marketing messages on the basis of this consent.

C. Message Frequency

Message frequency varies based on operational activity, dispatch demand, and the subcontractor’s geographic coverage area. Weekly availability pulse checks are sent on a scheduled basis, typically once per week. Emergency dispatch alerts are not sent on a fixed schedule and are triggered only when a matching opportunity is identified within the network. Speed-test and reflex messages are infrequent and purposeful. ConAxis implements rate-limiting controls, cooldown windows, and quiet-hours restrictions to prevent excessive or intrusive messaging volume.

D. Message and Data Rates

Standard message and data rates may apply to ConAxis SMS communications depending on the recipient’s wireless carrier plan and service agreement. ConAxis does not impose any additional charges for SMS communications sent through its platform. Recipients are responsible for any carrier charges that may apply under their individual plans.

E. Opting Out — STOP Instructions

Any recipient may opt out of ConAxis SMS communications at any time by replying STOP to any message received from a ConAxis number. Upon receipt of a STOP reply, ConAxis will send one final confirmation message acknowledging the opt-out request and will thereafter cease all SMS communications to that number.

Opting out via STOP will result in the removal of that number from the active dispatch pool. This may affect the subcontractor’s ability to receive emergency coverage opportunities and availability checks. To re-enroll in the ConAxis dispatch network following an opt-out, the subcontractor must contact ConAxis directly by phone or email to complete a new intake process.

F. Getting Help — HELP Instructions

Any recipient may reply HELP to any ConAxis SMS message to receive a response containing program contact information and a brief description of the ConAxis SMS program. The HELP response will include the following information:

  • Program name: ConAxis Contractor Coordination Network
  • Contact phone number: +1 (726) 266-3338
  • Contact email: alex@conaxis.app
  • Opt-out instructions (reply STOP to unsubscribe)

G. Supported Carriers

ConAxis SMS services are available on all major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, and regional carriers. Carrier support and delivery reliability may vary. ConAxis is not responsible for service interruptions, message delivery failures, or delays caused by the recipient’s wireless carrier.

5. Data Sharing and Disclosure

ConAxis does not sell, rent, or otherwise transfer personal information to third parties for commercial or marketing purposes. Data sharing is limited strictly to the operational requirements of the contractor coordination network, as described below.

Sharing with General Contractors: When a crew placement is confirmed, ConAxis may share limited subcontractor information with the requesting general contractor for the sole purpose of completing that placement. Shared information is limited to what is operationally necessary, such as the foreman’s name and direct mobile contact number. No additional personal or business information is shared beyond what is required for the confirmed engagement.

Automated Verification Data: Verification signals accessed from public government sources, including Secretary of State entity records, State Comptroller tax standing, and municipal permit portals, are used solely for internal compliance monitoring. This data is not shared with external parties.

Legal Disclosure: ConAxis may disclose personal information if required to do so by applicable law, court order, subpoena, or other valid legal process. ConAxis will endeavor to provide notice to affected individuals prior to such disclosure where legally permissible.

Business Transfer: In the event of a merger, acquisition, reorganization, or transfer of all or substantially all of ConAxis’s business assets, personal information held by ConAxis may be transferred as part of that transaction. Affected individuals will be notified of any such transfer in accordance with applicable law.

6. Data Retention

ConAxis retains personal and operational information for as long as is necessary to fulfill the purposes described in this Privacy Policy, subject to the following principles:

Active Profiles: Subcontractor and contractor profiles remain in the ConAxis system for as long as the individual or entity remains an active participant in the dispatch network. Profiles are updated continuously based on SMS interactions, document submissions, and automated verification signals.

SMS and Reliability Data: SMS response records and dispatch reliability scores are retained and continuously updated based on ongoing dispatch interactions. This data is essential to the operational function of the network and is not deleted during the active period of network participation.

Opt-Out and Removal Requests: Subcontractors who opt out via STOP or who formally request removal from the ConAxis dispatch network will be removed from the active dispatch pool. Residual data, including historical records, reliability scores, and documentation, may be retained for legal compliance, dispute resolution, and operational audit purposes following removal from active status.

Public Records Data: Verification data sourced from public government records is subject to the retention policies of the originating public authority. ConAxis does not independently control the availability or retention of such records.

7. Data Security

ConAxis employs industry-standard technical and organizational measures to protect personal and operational information against unauthorized access, disclosure, alteration, or destruction. These measures include restricted access controls, secure SMS ingestion architecture, and operational protocols limiting data access to authorized ConAxis personnel only.

Access to subcontractor and general contractor data is limited to authorized ConAxis operators on a need-to-know basis. Confidence metadata associated with subcontractor profiles — including signals classified as self-reported, inferred, or verified through dispatch activity — is strictly internal and is never exposed to external users or third parties.

ConAxis’s SMS ingestion systems are designed to be idempotent and secure, with controls in place to prevent duplicate processing, injection attacks, and unauthorized command execution via SMS input. Despite these measures, no information system or transmission method is completely immune to security risk. ConAxis cannot guarantee the absolute security of personal information transmitted to or from the ConAxis platform and does not warrant that its systems are impenetrable. In the event of a security incident affecting personal information, ConAxis will take prompt action and notify affected individuals in accordance with applicable legal obligations.

8. Your Rights and Choices

Individuals whose personal or business information is held by ConAxis have the following rights with respect to that information:

  • Right of Access: You have the right to request access to the personal and business information that ConAxis holds about you or your company.
  • Right to Correction: You have the right to request correction of any personal or business information that is inaccurate, incomplete, or out of date.
  • Right to Removal: You have the right to request removal from the ConAxis dispatch network at any time. Removal requests will be honored promptly, subject to the data retention provisions described in Section 6.
  • Right to Opt Out of SMS: You have the right to opt out of ConAxis SMS communications at any time by replying STOP to any ConAxis message or by contacting ConAxis directly. See Section 4(E) for full opt-out instructions.

To exercise any of the rights described in this section, contact ConAxis using the contact information provided in Section 12 of this policy. ConAxis will respond to all rights requests within a reasonable time and in accordance with applicable law. ConAxis does not discriminate against individuals who exercise their rights under this policy.

9. Children’s Privacy

The ConAxis platform and dispatch network are intended solely for professional business use by licensed contractors, subcontractors, construction professionals, and their authorized representatives. ConAxis does not knowingly collect, store, or process personal information from individuals under the age of eighteen (18).

If ConAxis becomes aware that personal information from an individual under the age of eighteen has been submitted to the platform, ConAxis will take prompt steps to delete that information from its systems. If you have reason to believe that a minor has provided personal information to ConAxis, please contact ConAxis immediately at the contact information provided in Section 12.

10. Changes to This Policy

ConAxis reserves the right to update or modify this Privacy Policy at any time. Changes may be made to reflect updates in operational practices, legal requirements, or the capabilities of the ConAxis platform. The “Last Updated” date at the top of this document will reflect the date of the most recent revision.

In the event of material changes to this Privacy Policy, ConAxis will notify active network members via SMS to the phone number on file and/or by posting an updated version of the policy at the ConAxis platform or associated web presence. Continued use of ConAxis services, including participation in the dispatch network or responding to ConAxis SMS communications, following notification of a material policy change constitutes acceptance of the updated Privacy Policy. If you do not agree to the updated policy, you must opt out of ConAxis SMS communications and contact ConAxis to request removal from the dispatch network.
